Acerta Analytics Solutions, Inc. an Ontario incorporated company (“Acerta,”“our,” “us,” or “we”) respects your privacy. Acerta develops machine learning and artificial intelligence (ML/AI) solutions that provide actionable insights for precision manufacturers.    

In that regard, we have created this Privacy Policy to let you know how we collect, use and disclose information when you visit the website www.acerta.ai or other websites (the “Websites”) where this Privacy Policy is posted, use our products or proprietary service known as Acerta (the “Service”), and otherwise interact with us.  

Your Consent to this Privacy Policy

By using the Service, you agree to this Privacy Policy and the collection, use and disclosure of personal information contemplated hereby. This is our entire and exclusive Privacy Policy and it supersedes any earlier version. We may change this Privacy Policy by posting a new version on our Websites or through the Service, and it is your responsibility to review the Privacy Policy periodically. When we update the Privacy Policy, we will revise the Revision Date above and may notify you or post a message on the Websites and/or through the Service. Your continued use of the Websites or the Service constitutes your agreement to this Privacy Policy and any updates. 

What We Collect and Why

There are two types of information that our Websites might collect during your visit: 

  • Personal Information: Personal Information means any information that may be used to identify an individual, including, but not limited to, first and last name, home or other physical address, email address and password, phone number, role/title, etc. We may ask you to provide Personal Information that will enable us to enhance your use of the Service, for purposes such as facilitating correspondence with you, providing the agreed Service(s), registering your entitlement to access certain special features, or completing transactions. It is always your choice whether or not to provide Personal Information. If you choose not to provide requested Personal Information, you may not be able to use certain features of the Service. Any Personal Information that you choose to provide will be kept confidential and used to support your relationship with Acerta and our products and services. Among other things, we want to help you quickly find information through our Service, leverage our tools to support your authorized use of our products and services, alert you to product upgrades, special offers, updated information and other new products and services from Acerta.
  • Technical Information. We may collect and use technical data and related information — including but not limited to details about your device(s), system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Service. We may also automatically receive and record information on our server logs from your browser, which could include your IP address, cookie information, browser information, and the page you requested. Technical information can be broken down into three sub-categories:
    • Network Traffic Logs. Network traffic logs allow us to monitor network traffic, detect computer viruses and other software that might damage computers or our network, and monitor and tune the performance of our network. In the course of such monitoring, we may detect such information as e-mail headers, addresses from network packets, and other information. Information from these activities is used only for the purpose of maintaining the security and performance of our networks and computer systems.  
    • Web Visit Logs. Websites routinely collect and store information from online visitors to help manage those sites and improve service. This information includes the pages visited on the site, the date and time of the visit, the internet address (URL or IP address) of the referring site, the domain name and IP address from which the access occurred, the version of browser used, the capabilities of the browser, and search terms used on our search engines.  
    • Cookies. Cookies are pieces of information stored by your web browser on behalf of a website and returned to the website on request. This site may use cookies for two purposes: to carry data about your current session at the site from one web page to the next, and to identify you to the site between visits. If you prefer not to accept cookies from our Websites, you may turn them off in your browser, or may set your browser to ask you before accepting a new cookie. Some webpages may not function properly if the cookies are turned off. Unless otherwise notified on the Websites, we will not store data, other than for these purposes, in cookies. Cookies remain on your computer, and accordingly we neither store cookies on our computers nor forward them to any external parties.  

How We Collect and Share Personal Information

While using the Websites, you may choose to provide us with information to help us better serve your needs. For example, you may contact us, request a product demonstration, request a free trial of our solution, or you may apply for a job. Any Personal Information you share with us will be used only for the purpose indicated. Requests for information will be directed to the appropriate personnel to respond to the request. Please be aware any Personal Information that you provide to us may be transferred, stored, maintained and used both within and outside the servers, communication and data processing facilities we maintain.  

If you sign up to receive marketing communications from Acerta, we may collect your first name, last name, company name, contact phone number, and email address (among other information) so we can send you mail or email regarding products and services that we believe are of interest to you. Similarly, if you subscribe to receive email notifications on our Websites, we will collect and store your email address so we can send you the information you request. You may also be added to our marketing email list when you create an Acerta Analytics account. If you do not wish to continue to receive marketing and promotional communications from us, you may opt out at any time by using the “Unsubscribe” mechanism in our marketing emails or by contacting us as set out under “Contact Us” below. Please note that you may continue to receive certain transactional and non-marketing account-related messages from Acerta.  

For the purposes of recruitment, some personal information is collected and shared with third-party applications such as Bamboo. Access to this information is restricted.  

Acerta does not rent, sell or share Personal Information it collects about you to or with third parties, and Personal Information collected from you is only used to provide you with our products and services and to comply with any requirements of law. 

Agents, service providers or contractors of Acerta may have access to your Personal Information on a need-to-know basis for the purpose of performing services on behalf of Acerta. All such agents, service providers or contractors who have access to such information are required to keep the information confidential and not use it for any other purpose than to carry out the services they are performing for Acerta or as otherwise required by law. 

Acerta, its agents, service providers or contractors may disclose Personal Information if required or permitted to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process such as in response to a search warrant to a legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities; (2) protect and defend the rights or property of Acerta or its agents, service providers or contractors; or (3) act in urgent circumstances to protect the personal safety of users of the Service or the public. Where a disclosure of our customers’ information is required by applicable law, we promptly notify our customer prior to complying with such requirements (to the extent we are not prohibited from doing so) and fully co-operate with our customer’s instructions with respect to our response.  

Acerta uses the HubSpot customer relationship management tool for marketing automation activities. We may collect and manage Personal Data using the HubSpot Subscription Service. We use your Personal Information to provide services to you as indicated in the above Personal Information section. Acerta uses the Salesforce customer relationship management database to store contact information about customers, prospective customers, and business associates of Acerta. We may share and manage your Personal Information on Salseforce. You can read more on Salesforce privacy policy. 

Acerta requires each customer of our web-based product(s) to sign an Acerta Software and Services agreement which documents that we transmit and process Customer Data from the Customer’s equipment or servers for the purposes of providing the Service. Customer Data might include first and last name, email address, and job title/role. 

Acerta uses a third-party analytics application, Pendo, to track user interactions with our product software for the purpose of determining the success of certain product features and to identify required help topics based on user behaviour. We do not share Personal Information with Pendo unless the Customer agrees to it explicitly in writing. You can read Pendo’s Trust Policy here 

How We Secure and Retain Personal Information

We maintain technical, physical, administrative, electronic, and procedural safeguards designed to protect your Personal Information. Our systems are designed to protect Personal Information from unauthorized usage on shared computers in that users are required to log in through our applications. 

We have Personal Information retention processes designed to retain Personal Information for no longer than necessary for the purposes of providing services to our customers or, with respect to the Websites, for the purposes set out in this Privacy Policy or to otherwise meet legal requirements.  

We may also retain aggregate information beyond this time for research purposes and to help us develop and improve our Services. You cannot be identified from aggregate information retained or used for these purposes. 

Our Websites may contain links to other websites that Acerta does not own or operate. We provide links to third party websites as a convenience to you. These links are not intended as an endorsement of or referral to the linked websites. The linked websites have separate and independent privacy policies, notices and terms of use. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. We encourage you to read the privacy policy of every website you visit. 

Additionally, certain Personal Information may be made available to third parties using our Application Programming Interface (“API”). Use of third-party applications developed using our API are subject to the terms of use and privacy policies of such third-party developers. You should be aware that such third-party applications may expose user information. 

We may use a third party such as Google Analytics to collect information about our Websites and how you use them, which may include the pages most read, time spent on page, zoom pattern, search terms, and other engagement data on the Websites. We use this information to better understand and improve our Websites and user experience. These third parties may use cookies and other tracking technologies. As per the notes above, Acerta uses the HubSpot customer relationship management tool for certain marketing automation activities and the Salesforce customer relationship management database to store contact information about customers, prospective customers, and business associates of Acerta. 

Who Has Access to Personal Information

If we receive a request from an individual to access or update Personal Information we maintain on behalf of a customer, we will direct that individual to the relevant customer. We will assist our customers wherever possible in responding to individual access requests. 

Subject to applicable law, you have the right to access, update and correct inaccuracies in your Personal Information in our custody or control. You may request access, updating and corrections of inaccuracies in your Personal Information in our custody or control by emailing or writing to us at the contact information set out below. We may request certain Personal Information for the purpose of verifying the identity of the individual seeking access to his or her Personal Information records.

If you wish Acerta to delete your Personal Information from our systems entirely, send your request to Marketing@acerta.ai. However, please note that this might impact our ability to provide you with anticipated Services.
